About these terms

These Terms of Service cover your use of the Matchmakers Elite app on iOS, Android and the web, provided by Matchmakers Elite LLC of 17W635 Butterfield Rd, Suite 318, Oakbrook Terrace, IL 60181 (“we”, “us”). By creating an account or using the app you agree to them.

The matchmaking service itself — what we do for you, fees, cancellation and refunds — is covered by the membership agreement you signed with us. How we handle your information is covered by the Privacy Policy. Our Member Guidelines apply to everyone.

Who can use the app

You must be 18 or over. You may use the app to apply for membership, and as a member to take part in the service. The app does not include public profiles, search, or messaging between members, and you may not use it to try to find or contact other members.

Your account and signing in

You sign in with your email address and a one-time code we send to it. Keep access to your email account secure: anyone who can read your email can sign in as you. Tell us straight away at anna@matchmakerselite.com if you think someone else has used your account.

One account per person. Do not share your account, sign in as someone else, or create an account for anyone else.

Using the app properly

Do not: break the law or our Member Guidelines using the app; upload anything you do not have the right to share, or anything sexual, violent, hateful or misleading; copy, screenshot or share information about other members; try to access information or parts of the app you are not meant to; interfere with or overload the service; use bots, scrapers or other automated tools; or reverse-engineer the service to get around its privacy protections.

We may remove content, restrict features, or suspend or close an account that breaks these terms. Where it is safe and lawful to do so we will explain why.

What you share with us

You keep ownership of the photos, recordings, answers and messages you add. You give us a license to store, copy, adapt (for example, resize a photo) and show them to our team, to the member you are introduced to as part of an introduction, and to partner matchmaking companies as described in our Privacy Policy — only as needed to run the service and for as long as you are a member, plus any retention period in our Privacy Policy.

You confirm that you have the right to share what you add, and that it is true and about you. After your application is complete, you can change your photos in the app; your matchmaker updates everything else.

Our content and the software

The Matchmakers Elite name, logo, design and the written content of the service belong to us or our licensors. These terms do not give you any right to use them except to use the service.

Payments

The app does not sell anything and does not take payments. Membership fees are agreed and paid directly with us outside the app, under your membership agreement.

Availability and changes to the app

We work to keep the app available and secure, but it may sometimes be unavailable for maintenance or for reasons outside our control. We may update, change or remove features. If a change significantly reduces what the app does for members, we will tell you in advance where we reasonably can.

Disclaimers

The app is provided “as is” and “as available”. To the extent the law allows, we make no promises about the app beyond those in these terms and your membership agreement — for example, that it will be error-free or uninterrupted.

We do not control, and are not responsible for, what members do outside the app, including at dates. See our Member Guidelines for how to stay safe and how to raise concerns.

Nothing in these terms takes away rights you have as a consumer that cannot be waived.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential loss arising from your use of the app, and our total liability for claims about the app is limited to $100. Our responsibilities for the matchmaking service itself are set out in your membership agreement.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded or limited by law.

Ending your use of the app

You can stop using the app, pause your account or delete it from Settings at any time. Deleting your account is permanent and does not by itself cancel your membership contract. We may suspend or close your account as described in these terms and your membership agreement.

Apple and Google

If you downloaded the app from Apple’s App Store, these terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it; to the extent the law allows, Apple has no warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US Government embargo and are not on a US Government list of prohibited or restricted parties.

If you downloaded the app from Google Play, these terms are between you and us, not Google, and Google Play’s terms of service also apply to your use of Google Play.

Governing law and disputes

These terms are governed by the laws of the State of Illinois. Disputes will be heard by the state and federal courts serving DuPage County, Illinois. If you live in another state, you keep the consumer protections its laws give you.

Changes to these terms

We may update these terms. We will change the date at the top and, for meaningful changes, tell you in the app or by email at least 30 days before they apply. If you do not agree, you can delete your account before the change takes effect.
